You must notify us promptly of any unauthorised use or suspected breach of security. Tide Sparrows is not liable for any loss or damage arising from your failure to safeguard your login information.

5. Acceptable Use Policy

You agree not to misuse the platform. This includes, without limitation, that you will not:

• 02 Upload or transmit any data that is unlawful, fraudulent, or infringes on the rights of a third party.

• 04 Reverse-engineer, decompile, or attempt to extract the source code of any underlying software or models.

6. Fees, Billing and Cancellation

Where Tide Sparrows offers paid plans, applicable fees will be disclosed prior to purchase. Fees are billed in advance on a recurring basis unless otherwise stated. You may cancel your subscription at any time through your account settings; cancellation will take effect at the end of the current billing cycle. Except where required by law, fees already paid are non-refundable.

7. Ownership and Licence

All content, software, design, trademarks, and other materials made available through Tide Sparrows are owned by or licensed to Tide Sparrows and are protected by applicable intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the platform for your own personal or internal business purposes.

By submitting Your Data, you grant Tide Sparrows a licence to process, store, and analyse it solely for the purpose of providing and improving the service, in accordance with our Privacy Policy. Nothing on the Tide Sparrows platform constitutes financial, investment, tax, or legal advice. All analyses, projections, and insights are generated by automated systems and are provided "as is" without warranty of accuracy, completeness, or fitness for a particular purpose. You should consult an appropriately qualified, independent professional before making any financial or investment decision.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Tide Sparrows and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or financial opportunity, arising out of or in connection with your use of, or inability to use, the platform, regardless of the legal theory on which the claim is based.

Our total aggregate liability to you for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid to Tide Sparrows in the twelve (12) months preceding the event giving rise to the claim, or a nominal amount where no fee was paid.

You agree to indemnify and hold Tide Sparrows harmless from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising out of your breach of these Terms, misuse of the platform, or violation of any applicable law or third-party right.

12. Suspension and Termination

We may suspend or terminate your access to the platform, without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or unlawful activity, or posed a risk to the security or integrity of the service. You may terminate your account at any time by contacting us or using the account controls provided.
